Terms of Service

These Terms of Service ("Terms") govern your use of the Unpicky mobile application ("the App"), operated by Family Software LLC ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Important health disclaimer — please read
Unpicky is a feeding-support tool, not a medical service. It does not provide medical advice, diagnosis, or treatment.
- The App offers general feeding guidance and activities based on common approaches to selective ("picky") eating. This guidance is not a substitute for professional care from a pediatrician, registered dietitian, feeding therapist, occupational therapist, or other qualified professional.
- The App does not know your child's full medical history. Its recommendations are general and may not be appropriate for every child.
- Do not use the App to manage food allergies, intolerances, or any medical feeding condition. If your child has a diagnosed allergy or medical condition, follow the guidance of your healthcare providers.
- Always consult a qualified professional before making changes to your child's diet, and before introducing any new food, especially if your child has allergies, a history of choking, restricted growth, or any medical condition.
- Stop using the App's suggestions and seek professional help if your child shows signs of an allergic reaction, choking, persistent distress, weight loss, or any other concerning symptom.
- In an emergency, contact your local emergency services immediately. The App is not designed for and must not be relied on in emergencies.
You are responsible for supervising your child during all feeding activities. You use the App's guidance at your own discretion and risk.
2. Who can use Unpicky
You must be at least 18 years old and the parent or legal guardian of, or an authorized caregiver for, any child whose information you enter. The App is intended for use by adults, not by children.
3. Your account & acceptable use
- You are responsible for the accuracy of the information you provide, including information about a child in your care, and for keeping your login credentials secure. Notify us promptly if you believe your account has been accessed without your permission.
- You agree not to: use the App for any unlawful purpose; enter information about a child you are not authorized to enter information about; disrupt, reverse-engineer, or gain unauthorized access to the App or its systems; or resell or commercially exploit the App without our permission.
- You agree to cover any reasonable costs or claims we incur that arise from your misuse of the App or violation of these Terms. This does not apply to costs arising from our own wrongdoing.
4. What Unpicky provides
We provide the App on an ongoing basis but may change, suspend, or discontinue features at any time. Weekly plans and recommendations are generated algorithmically; they are suggestions only, subject to the health disclaimer in Section 1.
5. Disclaimers & limitation of liability
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that any particular feeding outcome will result from its use.
To the fullest extent permitted by law, Family Software LLC and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the App, including any feeding outcome. Our total liability for any claim relating to the App will not exceed the amount you paid us, if any, in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
6. Content & ownership
The App, including its content, design, and underlying methodology, is owned by us. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Information you enter remains yours; how we handle it is described in our Privacy Policy.
7. Ending your use
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the App in a way that may cause harm or legal risk.
8. General
- Severability. If any part of these Terms is found invalid or unenforceable, that part will be limited or removed to the minimum extent necessary, and the rest will remain in full effect.
- Changes. We may update these Terms from time to time. We will revise the "Last updated" date above and, for significant changes, notify you through the App or by email. Continued use after changes take effect means you accept the updated Terms.
- Governing law. These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules.
